A counter affidavit filed in Anna University case has brushed aside the allegations of irregularities in filling up the seats under government's discretionary quota in the Anna University from 1999 to 2006 and also into the role of two senior police officers, who got engineering seats under the quota for their children in the Anna University . .
D Jothi Jagarajan, the secretary to government, public department, n-charge of home, prohibition and excise department, in his affidavit said the petition filed by Praba Kalvimani demanding CBI probe on alleged irregularities "is not maintainable either in law or on facts and the same is liable to be dismissed in limine."
The allegations against the two police officers --- additional director general of police (armed police) Narinder Pal Singh and additional direc tor general of police (law and order) K Rad h hakrishnan --- on getting engineering seats for h hakrishnan --- on getting engineering seats for the wards under the discretionary quota by ex their tend tending favours to AIADMK ministers in corruption cases, during their tenure in DVAC, were denied by Jagarajan.
"It is submitted that after perusal of the entire records, DVAC felt that there is no material to accede to the request of the petitioner regarding CBI probe against the two officers," the affidavit contended.
"The registrar, Anna University , in his letter stated that the Syndicate of Anna University has made provision to admit candidates under the category seats reserved for the government of Tamil Nadu," Jagarajan said in his affidavit.
"The wards of the police officers were allotted BE seats in College of Engineering, Anna University, under the provision made by the Syndicate of Anna University and both of these candidates had written Tamil Nadu Professional courses Entrance Examination and had eligible qualifying marks to get admission," the affidavit stated.
"The admission of children of the two police officers are under discretionary quota and will not amount to acceptance of illegal gratification as alleged by the petitioner. There is nothing illegal in availing the discretionary quota and allotment of seats under the government quota to the children of government servants, who could not secure admission in the regular procedure is perfect by valid and conformity with the law," he stated.
However, the affidavit is silent on the transcripts between the chief secretary K S Sripathy and then directorate of vigilance and anti-Corruption director S K Upadhyay .
